Terms of Service

These Terms of Service (“Terms”) govern access to and use of the software platform, applications, services, downloadable content, cloud-connected systems, telemetry integrations, aviation utilities, databases, digital content, and related technologies (collectively, the “Service”) provided by the operator, developer, licensor, distributor, affiliates, contributors, and associated entities (“Provider,” “we,” “our,” or “us”).
By downloading, installing, accessing, using, or interacting with the Service in any manner, the user (“User,” “you,” or “your”) acknowledges and agrees to be legally bound by these Terms and any future modifications thereto. If you do not agree with these Terms in their entirety, you must immediately discontinue use of the Service.
1. General Nature of the Service
The Service is an evolving software platform intended for informational, educational, simulation, training, planning, entertainment, workflow assistance, and situational-awareness purposes only. Certain components, modules, integrations, overlays, visualizations, procedures, telemetry systems, charting systems, routing systems, synthetic features, replay systems, navigation tools, weather systems, airport systems, or cloud-connected services may be experimental, developmental, incomplete, simulated, beta-stage, preview-stage, or otherwise undergoing active modification.
The Service may contain:
- software defects;
- computational inaccuracies;
- delayed information;
- heuristic estimations;
- incomplete aviation logic;
- interrupted services;
- rendering inconsistencies;
- synchronization failures;
- stale data;
- telemetry interruptions;
- incorrect route sequencing;
- airport data discrepancies;
- navigation anomalies;
- third-party dependency failures.
The User expressly acknowledges that complex software systems may behave unpredictably and that no guarantee is made regarding uninterrupted availability, operational correctness, completeness, or suitability for any specific use case.
2. No Certification / No Operational Reliance
THE SERVICE IS NOT CERTIFIED UNDER ANY AVIATION AUTHORITY, INCLUDING BUT NOT LIMITED TO FAA, EASA, ICAO, TRANSPORT CANADA, OR ANY OTHER REGULATORY BODY.
The Service is not intended to replace:
- certified avionics;
- approved navigation equipment;
- official charts;
- operational dispatch systems;
- collision avoidance systems;
- terrain awareness systems;
- certified electronic flight bags;
- air traffic control instructions;
- pilot judgment.
The User remains solely responsible for:
- compliance with applicable regulations;
- operational decisions;
- verification of aviation information;
- aircraft operation;
- navigation decisions;
- weather interpretation;
- situational awareness;
- terrain and obstacle clearance;
- fuel planning;
- approach execution;
- runway operations;
- taxi operations;
- emergency procedures.
No content, output, overlay, advisory, sequencing logic, synthetic guidance, or displayed information generated by the Service shall be interpreted as certified operational guidance.
3. Third-Party Systems and Data
The Service may utilize or depend upon third-party systems, including but not limited to:
- aviation databases;
- chart providers;
- weather feeds;
- NOTAM systems;
- telemetry systems;
- simulator SDKs;
- cloud infrastructure;
- mapping services;
- storage providers;
- networking services;
- publicly available aviation information.
Third-party systems may:
- change without notice;
- become unavailable;
- contain inaccuracies;
- introduce delays;
- alter formats;
- interrupt compatibility.
The Provider makes no representations regarding the reliability, completeness, legality, or availability of third-party content or services.
4. Simulator and Telemetry Features
Certain portions of the Service may integrate with simulator environments, telemetry systems, playback systems, replay systems, synthetic overlays, georeferenced chart systems, route reconstruction systems, or external applications.
Telemetry data may:
- jitter;
- disconnect;
- interpolate incorrectly;
- become stale;
- lose synchronization;
- misrepresent aircraft state;
- contain positional inaccuracies;
- produce delayed outputs;
- display incorrect altitude, speed, heading, or location data.
The User acknowledges that simulated or replayed environments do not represent operational validation or real-world certification.
5. Accounts, Cloud Features, and Digital Content
Certain functionality may require:
- authentication;
- online connectivity;
- cloud synchronization;
- remote downloads;
- digital entitlements;
- subscription systems;
- telemetry relays;
- online storage;
- premium content access.
Digital items, cosmetic content, downloadable assets, subscriptions, or unlockable features are licensed, not sold.
The Provider reserves the right to:
- modify features;
- alter pricing;
- revoke access;
- suspend accounts;
- discontinue systems;
- modify entitlements;
- remove integrations;
- reset cloud content;
- limit access to services.
Unless otherwise required by applicable law, digital purchases are non-refundable.
6. Acceptable Use
The User agrees not to:
- misuse the Service;
- interfere with infrastructure;
- bypass licensing systems;
- reverse engineer restricted systems;
- redistribute proprietary content;
- access unauthorized systems;
- disrupt networking services;
- exploit vulnerabilities;
- use the Service in violation of applicable law or regulation.
The User further agrees not to rely upon the Service for life-critical operational decision-making.
7. Experimental and Beta Features
Certain systems may be identified or implied as:
- experimental;
- beta;
- preview;
- advisory;
- prototype;
- synthetic;
- developmental;
- incomplete.
Such systems may behave unpredictably and may be modified, disabled, interrupted, or removed at any time without notice.
Use of experimental systems is entirely voluntary and undertaken solely at the User’s own risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE PROVIDER, INCLUDING ITS DEVELOPERS, CONTRIBUTORS, AFFILIATES, LICENSORS, CONTRACTORS, SERVICE PROVIDERS, DISTRIBUTORS, AND ASSOCIATED PARTIES, SHALL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, LIABILITIES, LOSSES, COSTS, EXPENSES, OR OTHER CONSEQUENCES ARISING FROM OR RELATED TO THE USE OF, INABILITY TO USE, RELIANCE UPON, OR INTERACTION WITH THE SERVICE.
THIS LIMITATION APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:
- DIRECT DAMAGES;
- INDIRECT DAMAGES;
- INCIDENTAL DAMAGES;
- SPECIAL DAMAGES;
- EXEMPLARY DAMAGES;
- CONSEQUENTIAL DAMAGES;
- ECONOMIC DAMAGES;
- OPERATIONAL DAMAGES;
- PERSONAL INJURY;
- PROPERTY DAMAGE;
- DATA LOSS;
- BUSINESS INTERRUPTION;
- AVIATION INCIDENTS;
- NAVIGATION ERRORS;
- TELEMETRY FAILURES;
- SOFTWARE DEFECTS;
- CHARTING ERRORS;
- WEATHER INACCURACIES;
- SYSTEM INTERRUPTIONS;
- AIRPORT DATA ERRORS;
- ROUTE SEQUENCING ERRORS;
- TRAINING OUTCOMES;
- FLIGHT OPERATIONS;
- RUNWAY OPERATIONS;
- TAXI OPERATIONS;
- SIMULATOR MALFUNCTIONS;
- OR ANY OTHER CLAIMS WHATSOEVER.
BY USING THE SERVICE, THE USER EXPRESSLY AGREES THAT ALL USE OF THE SERVICE OCCURS ENTIRELY AT THE USER’S OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE USER FURTHER AGREES TO WAIVE, RELEASE, AND FOREVER DISCHARGE THE PROVIDER FROM ANY AND ALL CLAIMS, CAUSES OF ACTION, DEMANDS, LIABILITIES, OR DAMAGES OF ANY KIND ARISING FROM OR RELATED TO THE SERVICE, WHETHER KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, FORESEEABLE OR UNFORESEEABLE.
9. Indemnification
The User agrees to defend, indemnify, and hold harmless the Provider and all associated parties from and against any claims, actions, liabilities, damages, judgments, costs, or expenses, including reasonable attorneys’ fees, arising from:
- use of the Service;
- violation of these Terms;
- misuse of aviation information;
- operational decisions;
- simulator integrations;
- regulatory violations;
- unlawful activity;
- third-party claims.
10. No Warranty
THE SERVICE IS PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
THE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY;
- FITNESS FOR A PARTICULAR PURPOSE;
- NON-INFRINGEMENT;
- OPERATIONAL RELIABILITY;
- CONTINUOUS AVAILABILITY;
- DATA ACCURACY;
- COMPATIBILITY;
- ERROR-FREE OPERATION.
No representation or warranty is made that:
- defects will be corrected;
- systems will remain available;
- information will remain current;
- integrations will continue functioning;
- downloads will remain accessible;
- telemetry systems will remain synchronized.
11. Modifications
The Provider reserves the unrestricted right to:
- modify these Terms;
- alter functionality;
- discontinue systems;
- suspend services;
- change integrations;
- modify databases;
- remove features;
- interrupt availability;
- update interfaces;
- revise entitlements;
- discontinue support.
Continued use of the Service following modifications constitutes acceptance of such modifications.
12. Governing Law and Severability
These Terms shall be governed by and construed under applicable law without regard to conflict-of-law principles.
If any provision of these Terms is determined to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms constitute the entire agreement between the User and the Provider concerning the Service and supersede all prior communications, understandings, or agreements relating thereto.
14. Acknowledgment
BY ACCESSING, INSTALLING, OR USING THE SERVICE, THE USER ACKNOWLEDGES THAT THEY:
- HAVE READ THESE TERMS;
- UNDERSTAND THESE TERMS;
- ACCEPT THESE TERMS;
- ASSUME ALL RISKS ASSOCIATED WITH USE OF THE SERVICE;
- UNDERSTAND THAT THE SERVICE MAY CONTAIN EXPERIMENTAL OR INCOMPLETE FEATURES;
- AGREE THAT THE SERVICE IS PROVIDED STRICTLY ON AN “AS IS” BASIS;
- AGREE TO THE LIMITATIONS, DISCLAIMERS, RELEASES, AND WAIVERS SET FORTH HEREIN.
